Introduction

These Terms of Service ("Terms") govern your access to and use of the Testhacker platform, including our website, mobile applications, web applications, and any related services (collectively, the "Services"), operated by Testhacker ("we," "us," or "our").

By creating an account or using any part of our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

We may update these Terms from time to time. We'll notify you of material changes via email or an in-app notice. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.

1. Eligibility

You must be at least 13 years of age to use the Services. If you are between 13 and 18, you confirm that you have your parent or legal guardian's consent to use the Services. By using the Services, you represent that you meet these requirements.

We reserve the right to refuse access to anyone at any time, for any reason, at our sole discretion.

2. Your Account

2.1 Account Creation

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration, and to keep your information updated.

2.2 Account Security

You are solely responsible for maintaining the confidentiality of your credentials — including your password and any one-time passcodes (OTPs). You agree to:

• Not share your account credentials with any third party.
• Notify us immediately at support@testhacker.app if you suspect unauthorized access.
• Accept full responsibility for any activity that occurs under your account.

2.3 Personal Use Only

Accounts are for your individual, personal use only. Reselling, sublicensing, or providing access to third parties — paid or unpaid — is strictly prohibited and may result in immediate account termination.

3. Platform Features & Behavioral Mechanics

Testhacker's Services may include behavioral coaching tools such as streak tracking, gamification, focus monitoring, progress analytics, and structured learning flows ("Platform Features"). By using these features, you acknowledge and agree that:

3.1 Focus Monitoring

Certain features of the platform may detect when you navigate away from the application or switch to other apps during an active study session. This data is used solely to provide in-session behavioral feedback and is subject to our Privacy Policy.

3.2 Streak & Progress Data

Streak counts, progress metrics, and learning scores are calculated based on your in-app activity and our internal system clocks. We make commercially reasonable efforts to maintain accurate records, but we are not liable for technical discrepancies caused by device issues, connectivity problems, or system maintenance.

3.3 No Guarantee of Outcomes

Testhacker provides tools to support habit formation and structured learning. We make no representations, warranties, or guarantees regarding specific academic outcomes, examination results, scores, rankings, or employment. Results depend entirely on the user's individual effort and consistency.

4. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law or regulation.
• Impersonate any person or entity, or misrepresent your affiliation.
• Attempt to gain unauthorized access to any part of the Services or its underlying infrastructure.
• Use automated scripts, bots, or scraping tools on the platform.
• Upload or distribute malware, spam, or any content that is harmful, offensive, or illegal.
• Reverse-engineer, decompile, or otherwise attempt to extract source code from the Services.
• Interfere with the operation of the Services or burden our infrastructure disproportionately.

We reserve the right to investigate and take appropriate action against violations, including suspension or termination of accounts and referral to law enforcement.

5. Subscriptions, Billing & Refunds

5.1 Subscription Plans

Some features of the Services are available only through a paid subscription ("Subscription"). Subscriptions are billed in advance on a recurring periodic basis (monthly or annually, depending on the plan you select).

5.2 Automatic Renewal

Your Subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date via your account settings.

5.3 Pricing Changes

We may change Subscription pricing with reasonable notice. Price changes take effect at the start of your next billing cycle.

5.4 Refund Policy

Refunds are not provided for partially used subscription periods unless we determine a technical failure on our end materially prevented access to core Services for an extended period. In such cases, you may be eligible for pro-rated account credits at our discretion. Contact support@testhacker.app to raise a billing concern.

6. Intellectual Property

6.1 Our Property

The Services and all their original content — including but not limited to software, algorithms, features, interfaces, branding, and functionality — are and shall remain the exclusive property of Testhacker and its licensors. All rights reserved. The Services are protected by copyright, trademark, and other applicable laws of India and international intellectual property conventions.

6.2 Your Content

If you submit any feedback, suggestions, or content to us, you grant us a worldwide, royalty-free, irrevocable license to use, reproduce, modify, and incorporate that content into the Services without obligation or compensation to you.

6.3 License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes.

7. Third-Party Services

The Services may contain links to or integrations with third-party websites or services. We do not control and are not responsible for the content, policies, or practices of any third-party services. Your interactions with third-party services are solely between you and them.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied — including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any content or information obtained through the Services will be accurate or reliable.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Testhacker and its directors, employees, agents, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising from:

• Your access to or use of, or inability to access or use, the Services.
• Any conduct or content of any third party on the Services.
• Unauthorized access to or alteration of your transmissions or data.
• Any other matter relating to the Services.

In any case, our total aggregate liability to you shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Testhacker and its officers, employees, agents, and partners from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your account and access to the Services at any time, with or without notice, for any reason — including but not limited to a violation of these Terms.

Upon termination, your right to use the Services ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property rights, disclaimers, and limitations of liability) shall survive.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Tamil Nadu, India.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
